Yes is ahead on all three proposed Virginia constitutional amendments in unofficial election night results from the Virginia Department of Elections. With 132 of 133 localities reporting late Tuesday, Nov. 3, 2026, Yes has 61.66% on the reproductive freedom amendment, 56.92% on the marriage amendment and 55.46% on the voting rights amendment, according to the unofficial election night results. The results are unofficial and can change.
Question 1: Reproductive Freedom
On the reproductive freedom amendment, Yes has 1,705,178 votes, or 61.66%, and No has 1,060,131 votes, or 38.34%.
Question 2: Marriage
On the marriage amendment, Yes has 1,584,905 votes, or 56.92%, and No has 1,199,620 votes, or 43.08%. The amendment would remove the ban on same-sex marriage.
Question 3: Voting Rights
On the voting rights amendment, Yes has 1,541,264 votes, or 55.46%, and No has 1,237,592 votes, or 44.54%. The amendment would provide for the fundamental right to vote and restore voting rights to people convicted of felonies upon release.

How the Count Works From Here
Each amendment needs a majority of the votes cast on that question. To reach the ballot, an amendment must pass the General Assembly in two successive sessions, with a House of Delegates election in between.
What’s Next
Results remain unofficial until local electoral boards and the State Board of Elections certify them, according to the Virginia Department of Elections. One locality had not yet reported when these numbers were taken. For what each amendment would change, see our explainer on the three amendments.
